Mortgages take note: the Law Commission thinks you might be special
The Law Commission recently published its consultation paper on updating the Land Registration Act 2002 (the Paper). Among the numerous proposals is one that will be of particular interest to mortgagees: views are invited on limiting the circumstances in which a mortgagee can claim against the Land Registry's indemnity. The effect would be to treat mortgagees as a special category of applicant but not necessarily to their advantage.

Dentons has advised Marshall Motor Holdings plc (Marshall), the AIM-listed motor dealer group with over 100 franchises in the UK, on its £106.9 million acquisition of Ridgeway Group (Ridgeway), the Newbury-based motor dealer group. The acquisition represents the largest motor retail deal that has been completed in the UK for more than 10 years.

In South Africa, consumers are protected by the provisions of the Consumer Protection Act 68 of 2008 (CPA) and its Regulations against unfair contract terms. Non-compliance with the requirements of the CPA and its Regulations relating to unfair, unreasonable or unjust contract terms could result in rendering the transaction or particular provision of a contract void. The CPA provides for a list of unfair contract terms to be avoided when entering into a transaction. Read more
