In South Africa, consumers are protected by the provisions of the Consumer Protection Act 68 of 2008 (CPA) and its Regulations against unfair contract terms. Non-compliance with the requirements of the CPA and its Regulations relating to unfair, unreasonable or unjust contract terms could result in rendering the transaction or particular provision of a contract void. On April 25, 2016, the Centers for Medicare & Medicaid Services (CMS) released its long-awaited Medicaid managed care Final Rule, the first update to Medicaid managed care regulations since 2002, and implements dozens of changes, revising existing standards and requirements for Medicaid managed care plans and aligning Medicaid and the Children’s Health Insurance Program (CHIP) with other sources of health care coverage, including qualified health plans (QHPs) under the Affordable Care Act's health insurance exchange marketplaces and the Medicare Advantage (MA) program. Late last week, the US District Court for the Central District of California struck a blow against the California Attorney General's Office and other supporters of the state's ongoing efforts to expand the public disclosure of nonprofit donor identity data. By granting the plaintiff's permanent injunction request in the matter of Americans for Prosperity Foundation v. Harris, the court effectively declared unconstitutional – at least "as applied" to Americans for Prosperity Foundation ("AFPF") – the Attorney General's implementation and interpretation of a California law requiring charitable organizations to file the names and addresses of their large donors with the state's public registry.
