Kevin handles liability claims arising out of commercial general liability, auto, umbrella and excess liability, directors and officers fiduciary and other forms of coverage. He has handled large, complex disputes arising under various forms of financial and surety bonds, including actions for recovery under the bonds. Additionally, in the first-party coverage area, he has handled numerous catastrophe claims involving many of the most prominent natural disasters in the past two decades, including claims arising under Hurricane Sandy, Hurricane Katrina, California earthquake and fire losses, and numerous tornados and hailstorms.
He represents a number of clients in class action litigation and develops and implements strategies for handling recurring discovery disputes in multiple jurisdictions and the coordination of coverage positions and litigation throughout the US. Kevin has particular expertise in cases involving asbestos, environmental and other mass torts, as well as challenges to claims handling processes and procedures or allegations of "institutional bad faith." Kevin also has significant experience in coverage issues concerning sexual molestation claims, coordinating clients' national litigation strategy.
Among the matters handled in his extensive environmental and litigation experience, Kevin has overseen or litigated numerous environmental cases, including litigation concerning the liability of many major oil companies involving retail outlets, distribution, pipelines, refining, chemical production and disposal at hazardous waste sites. He has defended environmental clean-up issues involving offshore outer continental shelf oil platform spills in California and Louisiana, including liabilities under the Oil Pollution Act and the Oil Spill Prevention and Response Act for pollution claims regarding damages to wetlands in the Gulf of Mexico under various forms of environmental coverage.
In addition, he has handled claims related to the design and operation of hazardous waste facilities and the transportation of hazardous waste. Kevin has handled many suits regarding asbestos issues, including litigation against many major asbestos manufacturers or installers in courts across the US. Kevin has dealt with numerous bankruptcy proceedings involving the insolvency of chemical or asbestos companies, including the implementation of trusts to handle future claims.
He has also worked on regulatory matters involving market conduct examinations concerning various claims practices and procedures, including catastrophe claims. He has consulted with, assisted and arbitrated on behalf of ceding insurers on reinsurance recoveries.
