2016 will likely be the year that Congress determines whether and how to update the 40-year-old Toxic Substances Control Act (TSCA). Previous proposals would give the US Environmental Protection Agency (EPA) enhanced authority to collect data and regulate potentially problematic chemical substances, clarify EPA’s obligation to protect confidential business information, and address the difficult issue of conflicting and duplicative laws by US states to restrict and ban commercial chemical substances.
