The Uyghur Forced Labor Prevention Act (UFLPA) went into effect on June 21, 2022. This new law creates a presumption that imports of all goods mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region (Xinjiang) of China, or by entities identified by the U.S. government on the UFLPA Entity List, are presumed to be made with forced labor and are prohibited from entry into the United States. This presumption also applies to goods made in, or shipped through, China and other countries that include inputs made in Xinjiang. The UFLPA creates challenges for all companies with supply chains that touch China and even more so for those that import goods tied by the U.S. government to the use of forced labor in Xinjiang, including cotton, garments, footwear, electronics, gloves, hair products, polysilicon, textiles, thread/yarn, and tomato products.

This course helped companies understand the UFLPA, the steps that can be taken now to comply, and what to do if goods are detained at U.S. ports. Eric Choy, who serves as the Executive Director, Trade Remedy Law Enforcement, Office of Trade at U.S. Customs and Border Protection, joined Dentons lawyers to provide unique insights about UFLPA compliance and enforcement from the CBP perspective.
