Dentons healthcare practice is presenting an all day CLE program for healthcare service providers covering key areas of the current legal landscape. The event will include seven sessions covering the following topics:


Program Agenda	Course Description
Fraud and Abuse Hot Topics and Q&A Session	This session will (i) suggest analytical approaches to Stark and Anti-Kickback issues related to hospital and physician relationships, (ii) provide updates on recent developments, and (iii) identify “open questions” left as yet unresolved by statutes, regulations and advisory opinions as illustrated by case studies.
Miscellaneous Medicare Compliance Topics – These Things Are Still Hot!	This session will (i) provide the federal regulatory compliance framework for analyzing the effective and permissible way to utilize mid-level providers, e.g., NPs, PAs, to support inpatient service lines, and (ii) discuss recent enforcement actions and settlements, and lessons learned. This session will also discuss (i) the continued primary relevance of provider-based requirements, and (ii) federal and state activity regarding expanding site-neutrality and its impact on hospitals reimbursement.
AI in the Workforce	AI as a technology has the potential to significantly disrupt the workforce. From tools for recruiting and employment decision making, to enhancing employee productivity and work enjoyment, AI is quickly becoming a critical technology within the workforce. With this promise, however, comes risk. Many employees are using AI without properly disclosing the tool. AI strategy is also often missing from the equation to ensure all uses of AI across the workforce are responsible and ethical. In this session, we will look at the emerging uses of AI in the workforce, the promise and peril of such tools, the legal landscape governing those tools, and best practice recommendations for ensuring the use of AI within the workforce is responsible and ethical.
Health Care Antitrust Policy in the Spotlight: Biden Administration’s Whole of Government Approach and the Road Ahead	This session will review key antitrust developments under the Biden Administration, including the finalized 2023 Merger Guidelines and recent healthcare antitrust actions.
Cybersecurity and Data Privacy	The regulatory environment for data privacy and cybersecurity in the U.S. healthcare sector is undergoing significant transformation. Innovations like AI and third-party tracking tools are intensifying compliance challenges, regulators are prioritizing cybersecurity more than ever, and new state privacy laws are introducing further complexities. In this session, we will explore these emerging legal trends and provide essential insights for health systems and providers to ensure compliance with HIPAA and beyond.
Developments in Employment Law 2024	This session will discuss employment law decisions handed down by the Supreme Court in recent terms, including Groff v. DeJoy that altered the standard for religious accommodations in the workplace and Muldrow v. City of St. Louis that revised the standard for showing a job transfer is discriminatory in nature. We will examine how employers should alter policies and practice to comply with these new laws. We will also discuss the significant rules instituted by federal agencies in the last year and the statues of those rules, including, the Federal Trade Commission’s Final Rule prohibiting non-competes and the US Department of Labor’s Rule amending the requirements and salary thresholds to satisfy exemptions under the Fair Labor Standards Act and compliance with the same. This session will discuss the Pregnant Workers Fairness Act (PWFA) that became effective on June 27, 2023. Under the PWFA, employers with 15+ employees must provide reasonable accommodations to workers with known limitations related to pregnancy, childbirth or related medical conditions unless such accommodation will create an undue hardship. We will also discuss the EEOC’s newly-released regulations providing interpretive guidance for the PWFA and early litigation related to the PWFA making its way through the courts across the country. Finally, we will discuss practical tips and best practices to implementing PWFA compliance into the workplace.
Privilege and Ethical Considerations for In-House Counsel	This session will discuss current and continuing ethics issues under the attorney-client privilege, the duty of technological competence, conflicts of interest, managing internal investigations, “reporting up” and reporting on fellow lawyers, and other ethics challenges faced by Healthcare lawyers in-house.

Accreditation:

CLE credit is being sought in California, Colorado, Georgia, Illinois, Indiana, Kansas, Kentucky, Missouri, Nebraska, New York, Pennsylvania, Tennessee, Texas, and Virginia. Credit for all other states must be applied for and submitted by individual attendees. Compliance with each state's MCLE requirements is the sole responsibility of the attendee.
