Cristina Wendel will provide an overview of recent developments relating to solicitor-client and litigation privilege in workplace investigations. She will highlight steps employers and counsel can take to protect investigative materials and offer practical tips to avoid unintentionally waiving privilege.
• Assessing credibility: Who to believe? Victoria Merritt will explore key factors for assessing credibility in investigations and how courts and tribunals are approaching conflicting evidence. She will share recent decisions and provide insight into how investigators can make sound, defensible findings.
• Procedural fairness updates from Ontario and Quebec. Stephanie Lewis will deliver a cross-provincial update on procedural fairness obligations, highlighting recent case law from Ontario and Quebec. She will share how these developments are influencing investigation standards and offer best practices to reduce legal risk.
