Experience

Forestry Administration of the Royal Kingdom of Cambodia and Pact, Inc.: Advising on the Oddar Meanchey Reducing Emissions from Deforestation (REDD) project. This is a pathfinder project, the first of its kind in Cambodia and among the first in the world. The project involves 13 community forestry groups, comprised of 58 villages, which protect 67,783 hectares of forestland in the Northwestern province of Oddar Meanchey. It is expected to sequester 8.3 million metric tons of CO2 for more than 30 years. The project has secured accreditation through the Voluntary Carbon Standard and the Climate Community and Biodiversity Standards. Our role has included advising on the terms of an Emissions Reduction Purchase Agreement and other transaction documents for the project, and advising on regulatory and policy issues relating to REDD projects in general.
Polish Ministry of the Environment: Advising on the terms of the Emissions Reduction Purchase Agreement, and general advice on enforceability, and the Kyoto regime. This transaction concerned the sale of assigned amount units (AAUs) issued under the Kyoto Protocol by the Polish Ministry of the Environment to two of the World Bank’s carbon funds: the Spanish Carbon Fund (Tranche 2) and the Carbon Fund for Europe (Window 2). Under the AAU Purchase Agreement, the Polish government agrees to use the proceeds from the sale of AAUs to help increase the energy efficiency of public buildings in Poland, under a Green Investment Scheme.
UK Government, Department of Energy and Climate Change: Advising on the Government's program to commercialize carbon capture and storage (CCS) technology. This is a substantial project of international significance, at the leading edge of the development of this new global industry. The Government seeks to establish a cost-competitive CCS industry in the 2020s through up to £1 billion of capital funding and additional operational support. Our team is working with in-house colleagues on the competitive procurement of projects to develop the capture of CO2 from power generation, its transport offshore and permanent subsea storage. The project includes working with an entirely new regulatory framework. This comprises new legislation, the design and market testing of novel contracts for capital support, working with new contracts for difference under the Government’s wider Energy Market Reform program and the implementation of the European Union CCS Directive.
