The US Treasury Department and US Trade Representative (USTR) recently announced controversial plans to negotiate a “covered agreement” on insurance with the European Union (EU), a move that it said will “level the regulatory playing field for U.S.-based insurers and reinsurers” but that critics hailed as “unnecessary and irresponsible.”
Self-driving cars are no longer the work of science fiction. Google has been testing varying levels of autonomous vehicle (AV) technology for several years. Other major automakers are following suit. This year a group of vehicle manufactures, most notably, GM, Honda and Toyota, established a testing facility called “Mcity,” a 32-acre fake town meant to simulate urban and suburban roads with traffic signals, movable building facades, fake underpasses, construction obstacles and more. The auto insurance industry must prepare to address the changes this technological disruption is expected to have on their business models, strategies and operations.
The new law addresses long-standing industry concerns and codifies opinions issued by the New York Insurance Department's (predecessor to the Department of Financial Services) Office of General Counsel, dating back to 1995, which generally state that a certificate of insurance may not provide obligations, conditions or coverages not contained within the underlying insurance policy. Article 5 takes a three-pronged approach to the issue, and empowers the NY Department of Financial Services (DFS) to levy fines for violations.
