United Kingdom: In a significant decision for the motor finance industry, with potentially broader read across to other lender-broker-consumer relationships, the Court of Appeal has unanimously held that, in the commonly encountered scenario of a motor dealer who also acts as credit broker, the lender can owe liability to the customer for insufficient (or non) disclosure of the payment of commission to the dealer.
