The German IP and Technology team advises international corporations in the industries of banking, energy, aviation, sports, fashion, luxury goods, office communications, IT, engineering, metallurgy, life sciences and pharmacy. For some clients, the team is the cornerstone of their intellectual property activities in Europe. Moreover, our scope of work comprises data protection, IT projects and outsourcing as well as IT litigation.
The team’s copyright, trademark, industrial design, know-how and patent protection encompasses litigation in German and European courts, including domestic and cross-border ex-parte injunction proceedings. Additionally, we also have forensic experience with unfair competition and technology disputes of all kinds (software protection, telecommunications law, patent license agreements, project difficulties); we have accompanied several arbitration proceedings with national and international arbitration courts (CAS, ICC, DIS, WIPO).
In the area of trademark prosecution, we possess substantial experience in all areas of German and international practice. We regularly deal with trademark portfolios of numerous corporate clients, and we advise on trademark availability, procurement and protection. We focus on world-wide trademark prosecution and enforcement strategies including trademark licensing agreements. Moreover, we are most familiar with disputable complex technical procedures, with filling documentation gaps and solving evidentiary problems. In our publication of July 18, 2018, we gave an overview of the most important changes introduced in the trademark law reform. Now the Trademark Law Modernization Act (MaMoG, the new provisions of the German Trademark Act will be referred to as the “new Trademark Act”) has come into force on January 14, 2019, although there are individual provisions that have different start dates.
On July 23, the UKIPO updated a declaration regarding the continuous protection of IP-rights, which also refers among other things to trademark rights. The statement also mentions the possibility of a hard Brexit. In the event of a failure of the negotiations with the EU, the UKIPO states that it would strive to mitigate disruptions and ensure a smooth transition.
