Discussions about a new bill to update the Data Protection Law No. 25,326

Discussions on a new bill to update of the Personal Data Protection Law No. 25,326 (the “Data Protection Law”) started in August 2022.

The Data Protection Law was enacted in 2000, and since then many bills have been drafted to amend the Law with no success.

This time, the head of the Data Protection Authority – (Agencia de Acceso a la Informaciòn Publica), is meeting with several experts in data protection and representatives of different chambers and business associations to rethink the Data Protection Law. The new bill is intended to be aligned with European GDPR and the Brazilian LGPD.

To guarantee the effective participation of all the individuals as stated by Decree No. 1172/2003, a public consultation process will start during September. To do so, a space for comments and contributions will be released next month on the Data Protection Authority’s website.
