A new resolution, No. 161/2023, has been established by the Agency for Access to Public Information (AAIP) to promote transparency and data protection in the use of artificial intelligence (AI). The AAIP is responsible for ensuring access to public information, promoting transparency, and upholding data protection laws (Law No. 25,326). Published on September 4, 2023, the resolution is based on the OECD AI Principles and UNESCO's Recommendation on the Ethics of Artificial Intelligence. It also takes into account previous Disposition No. 2/2023 of the Undersecretariat of Information Technology, which provided "Recommendations for Reliable AI".

The resolution creates a Program for Ensuring Transparency and Protecting Data when Using AI. The objective of the Program is to analyze and regulate AI development and use, both in the private and public sectors, while ensuring transparency and personal data protection. It aims to strengthen the State's capacity to protect citizens' rights and provide an AI Observatory to map relevant actors; follow regional and global regulations of technological developments based on AI; and provide statistics and reports on the subject matter.

The Program also provides for an interdisciplinary advisory council, comprising experts that will establish sector policies, and encourage cooperation between the AAIP and other governmental and juridical organizations to facilitate social participation and governance.

Finally, the Program will set guidelines for public and private entities regarding transparency and data protection in the use of AI, publish transparency criteria on the National Transparency Portal, and record all automated decision-making systems.
