Dick Mosher is a counsel in Denton's Honolulu office. He has 45 years of corporate and private practice legal and business experience, including extensive work in arbitration, mediation, cross-border commercial transactions, intellectual property licensing and protection, civil and criminal litigation, regulatory and environmental compliance, employment and labor law, M&A and strategic alliances, insurance coverage disputes, security law, captive insurance, charter schools and international business.
Dick has participated in numerous, multimillion-dollar US and international mediations and arbitrations, both as a mediator-arbitrator and as counsel for the participants. The disputes involved topics including Chinese and other Asian joint ventures, European marketing disputes (such as the Hoover Free Flights Dispute, involving thousands of court claims, millions of dollars in expenses and charter flights for more than 10,000 people), Middle Eastern distributor termination claims and European patent disputes.
Dick is a lecturer in professional responsibility (ethics) at the University of Hawai`i Richardson Law School and an AV-preeminent rated lawyer by Martindale-Hubbell. He is an officer for the Association for Conflict Resolution, Hawai`i Chapter; co-chair of the Hawai`i State Bar Association (HSBA) Alternative Dispute Resolution Section; on the panel of neutral arbitrators for the International Centre for Dispute Resolution (ICDR); on the panel of mediators for the new Kyoto, Japan Mediation Center; and one of the top mediators and arbitrators for the Hawai`i Supreme Court Center for Alternate Dispute Resolution. He lectures frequently on effective mediation and arbitration practice. Dick is also an officer of the HSBA Litigation, Business, International, Insurance Litigation and Intellectual Property sections.
Dick worked for 30 years as in-house chief legal officer, general counsel and associate general counsel for Maytag (including Maytag International), Hoover, Ball (including Ball Aerospace, Computer and Agricultural Systems) and Loctronix Corporation (wireless location technology). He was nominated for Employee of the Year by Ball Aerospace. He is a past chairman of three national committees of the Association of Corporate Counsel (ACC), a past president of ACC's Dallas-Fort Worth Chapter and a former ACC Chapter Volunteer of the Year. Dick is currently on the O`ahu Chapter Board of the Hawai`i Lodging and Tourism Association.
Dick served as a special assistant US attorney (SAUSA) in Utah on an identity theft task force. His litigation experience in state and federal courts includes nearly 100 first chair jury trial and more than 75 Equal Employment Opportunity Commission (EEOC) administrative trials. His employment experience includes all levels of training, counseling and litigation, including class actions.
He was the lead negotiator and attorney for numerous, multimillion-dollar US and international mergers, acquisitions and divestitures, including the purchase of the Blodgget Oven Company and the sale of Hoover's European vacuum business to Candy Group S.p.A. in Italy.
Dick has advised small, large startup, public private and governmental organizations on corporate litigation and compliance. He was a founding member of the Tacoma WA. Entrepreneurial Network. Dick was also a founding member of the "Managing Litigation as a Business" initiative, which conducted seminars for inside and outside counsel on approaching litigation management with a strategic partnership and process management emphasis. Dick has also taught programs on "Six Sigma" management of in-house law departments.
