El 05 de abril de 2022 el Presidente de la República actuando en Consejo de Ministros dispuso mediante el Decreto 106/022 dejar sin efecto el Decreto 93/020 del 13 de marzo de 2020.
El Decreto 93/020 declaraba en su artículo 1° el estado de emergencia sanitaria como consecuencia de la pandemia originada por el virus COVID-19.
En otras palabras, el Decreto 106/022 del 5 de abril del corriente dispone la finalización del estado de emergencia sanitaria.
Sin perjuicio del cese de la emergencia sanitaria, el artículo 2° del Decreto 106/022 establece que el cese de la emergencia sanitaria es sin perjuicio de cumplimiento de las medidas adoptadas a causa de la emergencia nacional sanitaria que se encuentren vigentes y en ejecución con plazo pendiente.
Lo anterior implica que no todas las medidas que actualmente se encuentran vigentes, cesan junto con el cese de la emergencia sanitaria.
Como es sabido, durante la emergencia sanitaria se adoptaron múltiples medidas a los efectos de reducir el riesgo de contagio en los espacios de trabajo. El hecho de que se haya dispuesto el cese de la emergencia sanitaria no implica necesariamente la terminación inmediata de dichas medidas.
A modo de ejemplo, el seguro de paro especial creado específicamente como una herramienta para reducir el impacto de la ausencia de trabajo en virtud de la emergencia sanitaria se mantendrá vigente hasta el 30 de junio de 2022. En la misma línea, las prórrogas extraordinarias del seguro de desempleo por suspensión total de actividades también se mantendrán vigentes hasta el 30 de junio del corriente.
En relación con las medidas de prevención e higiene general, el pasado 04 de abril de 2022, el Ministerio de Salud Pública emitió un protocolo de actualización de estrategias de vigilancia y control para COVID-19. Dicho documento establece una serie de recomendaciones como medidas preventivas generales para la población que pueden tomarse como referencia a pesar de no resultar obligatorias. Entre ellas, se destacan:
En esta línea, entendemos que las empresas pueden exhortar a sus empleados al cumplimiento de las medidas de prevención e higiene dentro del espacio de trabajo.
No obstante, específicamente en relación con el uso obligatorio de mascarillas en el lugar de trabajo, entendemos que el empleador únicamente lo podría exigir a los empleados la utilización del tapabocas de forma obligatoria, cuando la naturaleza de la actividad que desarrollan así lo requiera, debiendo ser razonable y objetiva dicha exigencia.
