Are we subject to GDPR? The territorial scope criteria under the new EDPB Guidelines

Certain technologies may inevitably be “cross border” (for instance, when data are processed in other jurisdictions, when devices are produced elsewhere or maintained remotely). With this post we will address one data privacy element to consider, namely the territorial scope under the GDPR, also taking into account the recent European Data Protection Board (“EDPB”) guidelines.

New EU regulation on the free flow of non-personal data: what is non-personal data and should I be worried about transfers of non-personal data?

November 22, 2019 A new regulation (2018/1807) on the free flow of non-personal data came into force on 28 May 2019. Not as (in)famous as its big brother the GDPR, this regulation remained largely unnoticed but can be equally important for businesses using data analytics in their business models (Internet of Things, artificial intelligence and machine learning, etc.).
