The National Administration of Drugs, Foods and Medical Devices (“ANMAT”) has issued Resolution 6924/2022 (the “Resolution”) that complements Decree No. 151/2022 (the "Decree") and the Healthy Eating Law No. 27.642 (the "Law"), by setting new guidelines for the application of the Law (learn more about this Law here)
The Resolution prohibits the advertising, promotion, and sponsorship of packaged foods and/or non-alcoholic beverages that contain at least one front-of-pack labelling, when such promotional actions are directed to minors or teenagers.
This prohibition applies to all goods, whether they are local or imported, and to campaigns by any kind of media – traditional or digital –.
The Resolution also sets that the advertising of products that contain at least one front-of-pack labelling shall not include children's characters, human actors, cartoons, licensed characters, or caricatures, of any origin and animation technique, celebrities, athletes, pets, nor the award of prizes or gifts.
In other cases – that is when the advertising, promotion or sponsorship it is not specifically aimed at children and adolescents –, such actions must provide adequate information about the product, describing its characteristics accurately without misunderstandings, providing truthful, precise, and clear information.
