There is strong evidence that group litigation in England and Wales is in a period of exponential growth. While the starting point for this growth has traditionally been in the Competition Appeal Tribunal due to the availability of the "opt-out" regime in competition claims, the demand to ensure litigation provides a route for corporate accountability and encouragement from specialist claimant law firms and litigation funders means actions are increasing in other English courts. These proceedings are testing the boundaries of existing group litigation procedures and the courts' ability to case manage large claims. In this series, we spotlight current hot topics and upcoming developments in UK group litigation and their implications for corporates across all sectors.
