On May 21, 2021, Aigoul Kenjebayeva, Dentons’ Managing Partner in Kazakhstan and Central Asia, and Daniyar Toigonbaev, Partner and Head of the Dispute Resolution practice, presented at a roundtable on: "Topical issues of investment legal proceedings”. The event was organized by the Supreme Court of the Republic of Kazakhstan jointly with the Representative Office of the American Bar Association (ABA ROLI).

The online discussion was attended by judges, members of the International Council, representatives of government agencies, NPP Atameken, Astana International Financial Center (AIFC), investors, members of the legal and business communities, international experts on topical issues of investment justice. In total, more than 200 people attended from four countries.

Aigoul Kenjebayeva and Daniyar Toigonbaev presented the results of a legal analysis of the new Administrative Procedure and Process-Related Code ("APPC"), which will take effect on July 1, 2021. They noted the key novelties and gaps in the regulation of dispute resolution involving investors under the upcoming APPC. They also highlighted the shift in judges’ thinking with regard to investment disputes as well as how lawyers should prepare for work in the context of the new APPC. The two lawyers proposed the creation of special advisory bodies (Users ’Committee) at the Supreme Court and regional courts for the purpose of discussing problematic issues of the work of the judicial system and the administration of justice by representatives of the legal community and the judiciary.

During the event, the Chairman of the Specialized Board of the highest judicial body of the Supreme Court, Aigul Kydyrbaeva presented Aigoul Kenjebayeva with the medal of the Supreme Court "For Contribution to the Development of International Cooperation".

Based on the results of the discussions, the participants agreed on recommendations to improve legislation and judicial practice on the resolution of investment disputes, the application of the APPC, and the protection of investors' interests in tax disputes.
