Unfair contract terms and the consequences thereof under the CPA

In South Africa, consumers are protected by the provisions of the Consumer Protection Act 68 of 2008 (CPA) and its Regulations against unfair contract terms. Non-compliance with the requirements of the CPA and its Regulations relating to unfair, unreasonable or unjust contract terms could result in rendering the transaction or particular provision of a contract void. The CPA provides for a list of unfair contract terms to be avoided when entering into a transaction.
