A few weeks ago, the Work from Home Regulations were published in the Official Gazette, by Executive Decree No. 42083-MP-MTSS-MIDEPLAN-MICITT, based on Law No. 8738 “To Regulate Work from Home”, which provided that the Executive Power would issue the Regulations of this Law within the next three months after the publication of Law No. 8738.

The Regulations are divided into three chapters. The first, regarding General Provisions, which sets forth, among others, the obligations and duties of employer and employee; the content that must be included in the work from home agreement or addendum that must exist in each workplace where work from home is a practice; and the steps for the employer to revoke work from home, if necessary.

The second chapter regulates the government recognition for employers who incorporate good practices in the application and promotion of work from home and comply with the provisions of the “Work from Home Regulations”.

Finally, the third chapter refers to work form home in the public sector and the creation of a Work from Home Technical Coordination Team.

Employers who already apply work from home must update or create internal policies and adapt them to what is requested in these Regulations.
