Congratulations to Promontory Point Resources for its victory before the Utah Court of Appeals. Rejecting various environmental assertions and procedural arguments, on May 25, 2023, the Court upheld the company’s permit modification to relocate certain groundwater monitoring wells for its municipal waste landfill. The Court affirmed the state agency’s finding that the monitoring wells will detect leaks, if any, from the landfill. The decision allows the company to proceed with accepting municipal waste generated within Utah.
