On 22 November, 2021, Law 10,050 came into force. This law declares August 31^st as an official national holiday and commemorates the "Day of the Black Person and Afro-Costa Rican Culture". This new holiday was established as a non-mandatory payment holiday.

Employees who receive daily or weekly payment (in non-commercial activities), are not entitled to receive payment of this holiday if they do not work that day, but if they work during this non-mandatory payment holiday, then they will be entitled to receive their ordinary daily salary. In these cases, overtime payment during this type of holiday is equivalent to time and a half (1.5) the regular hourly wage.

Companies with fortnightly or monthly payment and those dedicated to commercial activities must pay mandatory and non-mandatory payment holidays, because these are already included in the employees’ ordinary monthly salary. In this case, regardless of whether the employee works on a mandatory payment holiday or a non-mandatory payment holiday, the employee is entitled to receive an additional equal daily salary payment, to make it double. Overtime in this case must be paid a three times the regular hourly wage.

For 2022 and 2023, this holiday will be officially enjoyed the following Sunday after August 31^st, therefore, the official holiday date for 2022 will be Sunday, September 4^th, 2022 and, for 2023, it will be Sunday, September 3^rd, 2023.
