The insolvency and restructuring community will welcome the clarity the case of Grove Independent School Ltd, Re [2023] EWHC 2546 (Ch) has now given on the test to be applied by the court in deciding whether to exercise discretion to grant an order for a Part A1 standalone moratorium: a procedure that was introduced into the insolvency toolkit in 2020 but, up until now, has been underused.
