It has been almost a year since the new regulations on state aid in the Polish Investment Zone came into force, introducing changes such as the deferred application of the tax exemption, the obligation to demonstrate the arm’s length character of the eligible costs and the modification of the rules for eligible cost recognition, significant amendments (including partial tightening) to the qualitative criteria, the extension of employee-related commitments or the new rules concerning the energy infrastructure being qualified as an eligible part of a new investment.

During the online meeting, we will therefore focus on reviewing, from the point of view of existing and potential investors, how the new rules have been applied in 2023 in practice and what risks and opportunities they create.

In addition, during our meeting we will also address:

• the most important trends in fiscal and judicial practice related to the PIZ exemption;
• crucial changes in the application of the PIZ exemption and other tax incentives, following the entry into force from 2024 of various laws on minimum taxes, levied both at the national level and in other countries in accordance with the GloBE rules (Global Anti-Base Erosion Model Rules – Pillar Two);
• guidance on how investors can prepare for these key changes;
• other incentives that investors can benefit from, including both the grants provided under the recently revised rules and other tax instruments.
