• Representing a leading Polish construction company in ICC arbitration proceedings against a leading international water industry company in connection with the settlement of a consortium agreement entered into between the parties in order to perform a contract on expanding one of the largest sewage treatment plants in Poland.
• Representing an international supplier of IT technology for the financial and insurance sectors in arbitration proceedings against the largest Polish insurance company in connection with a high-tech computer system implementation.
• Representing Portuguese construction companies in arbitration proceedings against a former member of their consortium concerning settlement of the consortium agreement entered into among the parties in order to implement a road construction investment, in connection with a construction site abandoned by a consortium member who was declared bankrupt.
• Representing a recognized Warsaw developer operating on the real estate market of class AAA facilities in several arbitration proceedings against a Polish construction company in connection with the settlement of an improperly performed stonework contract.
• Representing an entity of the Polish public finance sector, acting as the employer, in arbitration proceedings against a German construction company to determine the absence of the contractor’s right to request additional payment of the indirect costs of a road investment implementation during an extended time for completion.
• Representing a Portuguese construction company in arbitration proceedings against a former member of a consortium concerning settlement of the consortium agreement entered into between the parties in order to implement a road construction investment in Podkarpacie, and in particular involving the settlement of an internal agreement on sharing the risk of increase in construction material prices during the period of the investment implementation.

Litigation

• Representing a Polish rail carrier in several disputes against the leading railroad infrastructure company in Poland in connection with a collision of two trains carrying high-risk goods, resulting in damage to the railroad infrastructure and the natural environment.
• Representing a leading developer operating on the Warsaw real estate market of class AAA facilities in a dispute against the City of Warsaw, as part of which it sought damages in connection with an excessively protracted administrative procedure for the issuance of a building permit for the construction of the largest shopping mall in Poland to offer luxury fashion brands.
• Representing Portuguese construction companies in a dispute against a Polish city in connection with settlement of a contract for an intercity road construction, including increasing the amount of the contractual remuneration due to an extraordinary increase in the prices of construction means.
• Representing the largest European inland waterway carrier in several disputes against the journalists and publisher of a leading national daily newspaper in connection with infringement of its moral rights as a result of publication of untrue information on economic crimes it allegedly committed as part of its business activity.
• Representing a consortium of leading consulting firms, composed of a British and a Polish company, in a dispute against the employer – an entity of the Polish public finance sector – involving a claim for declaring the termination of an agreement on provision of a contract engineer ineffective.
• Representing an international consortium of construction companies in a dispute against the State Treasury (the General Directorate for National Roads and Motorways) in connection with settlement of a road construction investment, including the costs incurred by the contractor as a result of accelerating work performance due to an illegitimate refusal to extend the time for completion.
• Representing Portuguese construction companies in proceedings to secure claims against the leader of an international construction consortium concerning improper performance of the leader’s duties under the consortium agreement executed to perform a contract for the construction of a major motorway in Poland.
• Representing a former General Director for National Roads and Motorways in disputes against the journalists and publishers of two leading national daily newspapers in connection with infringement of his moral rights as a result of publication of untrue information alleging offenses committed as part of the public office he previously occupied.
• Representing two members of an international construction consortium in a dispute against the State Treasury (the General Directorate for National Roads and Motorways) in connection with an agreement on engineering and construction of a major motorway in Poland having been terminated by the contractor as a result of the employer’s failure to submit a guarantee of payment of the remuneration due in consideration of construction work.
• Representing an international construction consortium, acting as creditor, in bankruptcy proceedings of a major Polish construction company, in connection with its claims for payment under a subcontract entered into for the construction of the first Polish liquefied natural gas terminal.

Public Procurement

• Representing a subsidiary of the largest (in terms of revenues generated) energy group worldwide in an appeal procedure conducted before the National Chamber of Appeal and concerning a tender procedure for awarding a contract on a substation alteration.
• Counsel to a Polish infrastructure construction company in the course of its negotiations with a leading railroad infrastructure company in Poland concerning termination of a public procurement contract for a railroad line’s modernization.
• Counsel to an entity of the Polish public finance sector, acting as the employer, in the course of its negotiations with a German construction work contractor, concerning payment for additional works performed outside the original scope of the awarded public procurement contract, as well as increase in the amount of remuneration due to the contractor as a result of its completion of the investment during an extended time for completion.
• Representing recognized construction companies in Polish and international arbitration and court proceedings against entities of the Polish public finance sector, acting as the employers, involving claims in connection with settlements of construction investments implemented pursuant to the provisions of the Public Procurement Law, including investments under FIDIC contracts.
