Disputes are a part of doing business; at Dentons, resolving them is our business. Alternative dispute resolution (ADR) is one of Dentons' core practices. Litigation may be a necessary component of a dispute resolution strategy, but it is only one of the problem-solving tools we apply to resolve disputes.
As the use of ADR has grown, so too has the sophistication of the processes we employ. Effective, successful use of ADR mechanisms requires counsel with specialized training and experience. Dentons has long been at the forefront of ADR development, investing significantly in training our lawyers. Experienced in the full range of arbitration, negotiation, mediation and settlement techniques, including settlement counsel, we are a globally recognized ADR leader.

Section 68 of the English Arbitration Act 1996 (s.68) allows the English courts to set aside an award on grounds of serious irregularity. In a rare example of a successful challenge under s.68, the Commercial Court in the recent case of RJ v. HB  EWHC 2833 (Comm) partially set aside an ICC award in a US$75 million banking dispute.
Earlier this year, the Alberta Court of Appeal released a decision that will be of interest to owners and contractors alike in the situation of tendering a contract.
In a March 2018 decision, Urban Mechanical v. University of Western Ontario, 2018 ONSC 1888, the Ontario Superior Court of Justice held that a subcontractor who had failed to deliver a “notice of dispute” under the subcontract, was deemed to have conclusively accepted a decision of the general contractor denying its claim for additional compensation.
This case serves as a reminder that parties to construction contracts should strictly comply with the notice provisions in dispute clauses, to avoid discovering they have waived certain claims.
