In the International Tax Competitiveness Index 2022 (ITCI) prepared by the Organization for Economic Cooperation and Development (OECD), Poland ranked 28th out of 38 countries. Compared to last year, our country has moved up two positions, but is this positive change in the ranking noticeable to entrepreneurs at the level of everyday business operations? Does it translate into more efficient business operations in the Polish tax system?

Unfortunately, the Polish tax system remains one of the most complicated in the world. The year 2023 is not particularly easy due to the number of planned and implemented tax changes, new obligations, duties and sanctions. The future does not promise to be any better. Taxpayers must therefore constantly monitor the rules and keep abreast of domestic and international changes.

The Dentons Tax Day conference aims to provide a platform for the exchange of knowledge and experience between Dentons experts, business representatives and academics in order to broaden horizons and improve tax qualifications.

The inaugural edition of Dentons Tax Day will include – in addition to keynote speech – five substantive panels on key yet complex tax issues at the level of international and local regulations.

10:40-11:10	Panel I: Investments and structures in the new era of international taxation – how to live? Various initiatives at OECD and EU level to change the principles of international tax law (e.g. Pillar I and II, ATAD 3, BEFIT) will have a significant impact on the tax position of many companies. Do these changes only create new challenges and risks for companies? Or can the resulting benefits be identified? What should taxpayers be aware of? The panel will discuss these practical issues. Withholding tax (WHT) is also one of the main areas of scrutiny in tax and customs audits. During this panel, we will discuss the latest trends in the jurisprudence of tax authorities and administrative courts, as well as the main ways and strategies to manage tax risks in this area. Tax and customs controls have become more efficient in recent years, which can cause increasing anxiety for taxpayers in the current situation of economic uncertainty and market fluctuations. This panel will discuss the latest audit trends and experiences, as well as dispute resolution strategies, with a particular focus on transfer pricing, which is currently a key area for tax risk management. 12:30-13:00	Panel IV: Indirect tax challenges The coming months are a time of anticipation and preparation for the revolutionary changes in business caused by the entry into force of the National Electronic Invoicing System (KSeF) and the introduction of the Carbon Border Adjustment Mechanism (CBAM). The panel will discuss how to prepare organizations (including groups) for the mandatory reporting of imported goods, as well as the process of implementing the mandatory invoicing requirements for companies. 13:00-13:30	Panel V: Incentives for Investment and Innovation: Current Perspectives on Grants and Fiscal Instruments During the panel we will talk about currently available grants from EU and national funds (including deadlines and procedures and conditions for obtaining funding), prospects for launching additional funds and grant programs, as well as practical problems in obtaining and accounting for grants. We will share experiences and present the point of view of companies applying for and benefiting from grants. We will also focus on tax instruments as alternatives or complements to grants and current issues and trends in the use of tax incentives by companies.
