Act on ensuring access to critical raw materials – a new pillar of Poland’s natural resources security

Poland: The Polish Council of Ministers has presented the key principles of the Draft Act No. UC83 on Ensuring Access to Critical Raw Materials and Resources Essential to the National Economy (“Draft Act”), which is expected to be adopted by the Council of Ministers in Q2 2025. Subsequently, the draft will be processed through the legislative process in the Polish Parliament before being signed by the President of Poland. The complete text of the Draft Act has not yet been published.

Draft amendment of the Polish Distance Act and its impact on the planning procedures for wind farms

Poland: On 21 March 2025, the Polish government adopted a draft amendment to the co-called Distance Act, submitted by the Minister of Climate and Environment (draft UD89). Subsequently, on 24 March 2025, the draft amendment was forwarded to the lower house of parliament, the Sejm.

Further changes to Poland’s PPA reporting requirements

Poland: In the February edition of Powered by Dentons, we reported on a change in the interpretation regarding the reporting of PPA contracts by the President of URE. According to the information provided by the President of URE on January 30, 2025, reporting was to cover all PPA contracts, both those concluded with end consumers and those concluded with other entities, such as trading companies.

New proposal to amend the Polish Energy Law regarding grid connection proceedings

Poland: On 24 March 2025, a new government proposal to amend the Energy Law (UC84) was published (“Project”). It introduces several important changes to the current regulatory framework for grid connection. The proposal is aimed at optimising the use of existing grid infrastructure and increasing the transparency of the grid connection process. Public consultations of the Project are now open.
