Experience

Philips v. Transtate(WDNC): Brought in by client to take over defense in long-pending case involving copyright infringement claims, DMCA violations, Computer Fraud and Abuse Act, and trade secret misappropriation. The case went to a four-week federal trial.
Philips v. Avante Health (NDIL): Retained to defend new case brought by Philips against Avante Health and Global Medical Imaging alleging claims for copyright infringement, DMCA violations, Computer Fraud and Abuse Act, and trade secret claims.
PolyOne Corp. v. Lu, et al. (NDIL): Counsel to specialty manufacturer of thermoplastic elastomers (TPE) against alleged misappropriation of competitor’s formula and processing techniques in three week federal trial.
Honeywell International, Inc.: Provide intellectual property litigation and strategic counselling for Honeywell International, Inc. – Aerospace Division. We have advised on matters involving patents, trademarks, copyrights, trade secret, and technology agreements across the US.
Rokt Corp. v. AdsPostX, Inc.(SDNY): Representing plaintiff against competitor in working to obtain a preliminary injunction alleging trade secret misappropriation, fraud, breach of contract, and unfair competition. The case is pending.
Neighborly: Represented the client, the world’s largest home services company, in week-long trial of theft of trade secrets and trademark infringement suit in the Western District of Texas. Won a judgement of more than $3.6M in damages and granting the requested permanent injunctive relief, and dismissing all of defendant’s counterclaims.
Homebridge: Defended client in a week-long trial of claim theft of trade secrets dispute in the Western District of Texas. Jury returned a complete defensive victory finding that the Plaintiff had failed to show the information allegedly uses qualified as trade secrets under the DTSA or TUTSA.
Yotrio Corp. v. Coop et al. (CDCA): Counsel to furniture manufacturer alleging trade secret misappropriation against former employee and competitor concerning designs and customer information.
JJ Plank Co, LLC v. Bowman (WDLA): Counsel for paper processing equipment manufacturer asserting trade secret misappropriation and violation of restrictive covenants against former plant manager hired by competitor.
Flex Ltd. (Fed. Cir.): Represented intervenor Flex Ltd. in defending on appeal three ITC decisions in its favor finding no trade secret misappropriation and invalidating the asserted patents. Appeal was dismissed.
Applied Predictive Technologies, a subsidiary of Mastercard (DUT): Representing plaintiff in a patent infringement and trade secret misappropriation suit against a competitor. Dentons has battled aggressive motion practice that has repeatedly sustained its trade secret misappropriation claims, supported its extensive damages claims and enabled complex forensic examination to support its claims against its primary competitor. The case involves defendants’ misappropriation of trade secrets essential to APT’s core technology, the Test & Learn® software system. Additionally, our team recently persuaded the Patent Trial and Appeal Board to deny a challenge to a patent owned by APT.
Eastern Asia-based manufacturer of industrial materials and synthetic fibers: Serving as co-lead counsel defending in a trade secret misappropriation case in the US District Court for the Eastern District of Virginia (Richmond Division). The litigation involves technologies for spinning and manufacturing para-aramid fibers. The jury awarded damages to the plaintiff; however, we were successful in arguing JMOL motions resulting in the dismissal of statutory conspiracy claims that could have resulted in treble damages, saving the company billions of dollars. We continue to advise the company in post-trial proceedings, including post-trial asset discovery and in the appeal currently being briefed before the US Court of Appeals for the Fourth Circuit.
United Microelectronics Corp. (UMC) v. Silicon Integrated Systems Corp. (SiS) (NDCA): Lead counsel representing SiS in patent infringement and trade secret case alleging willful infringement of United States Patent No. 5,559,352 and United States Patent No. 6,117,345 and misappropriation of trade secrets relating to semiconductor fabrication methods.
Laureate Education, Inc. v. National-Louis University, et al. (D. Md.): Lead trial counsel representing National Louis University (National-Louis) in a lawsuit brought by Laureate, Inc., the world’s largest for-profit educational business, seeking to enjoin National-Louis from employing its new president, who formerly was a top-level executive at Laureate. On behalf of National-Louis, we defeated Laureate’s motions for a temporary restraining order in the Maryland Circuit Court and the United States District Court for the District of Maryland, transferred the case to Illinois and secured National-Louis’ rights to the services of its president.
Certain Lithium Ion Batteries, Battery Cells, Battery Modules, Battery Packs, Components Thereof,and Processes Therefore, Inv. No. 337-TA-1159 (ITC): Represented LG Chem in action against SK Innovation for the misappropriation of LG Chem’s trade secrets for lithium ion batteries. Matter settled for a reported $1.8 billion after finding of default against SK Innovation based on document spoliation.
Financial services companies: Represented a major private equity firm in suing a former employee for misappropriation of trade secrets relating to computer trading models and quantitative trading strategies, resulting in a judgment enjoining the former employee and requiring destruction of all confidential information in the former employee’s possession.
Golf Now: Representing a cable television network against claims of unfair trade practices, theft of trade secrets and computer fraud and abuse asserted by competing company EzGolf claiming Golf Now improperly lured a former employee away.
Technology company: Representation of software company in trade secret claim seeking over $50 million.
Life sciences company: Representation of life sciences/agricultural company in nine-figure breach of contract and breach of fiduciary duty arbitration, and in separate multi-million dollar trade secret claim.
Agricultural company: Successful representation of leading agricultural company in trade secrets litigation.
Educational and sports start-up: Obtained complete dismissal at pleading stage for educational and sports start-up company in trade secrets litigation.

Fighting Back Against Foreign Trade Secret Theft: U.S. House of Representatives Approves H.R.1486

May 7, 2025

On May 5, 2025, the U.S. House of Representatives passed H.R.1486, the Economic Espionage Prevention Act (EEPA). Introduced by Rep. Rich McCormick (R-GA), the EEPA seeks to bolster protections for U.S. trade secrets and proprietary information by authorizing the President of the United States to impose sanctions on foreign adversary entities that knowingly engage in economic or industrial espionage.

USTR Releases 2025 Special 301 Report on Global IP Protection and Enforcement

The Office of the United States Trade Representative (USTR) has released its 2025 Special 301 Report, an annual review of intellectual property (IP) protection, enforcement, and related market access issues among U.S. trading partners. Mandated by Section 182 of the Trade Act of 1974, the report identifies countries with inadequate IP protection or enforcement practices that harm U.S. innovators and creators, categorizing them on the Priority Watch List or Watch List based on the severity of these issues.
