In a 7-2 decision, the United States Supreme Court recently expanded the extraterritorial reach of patent damages with its decision in WesternGeco LLC v. ION Geophysical Corp., No. 16-1011, holding that a patentee can recover profits from lost foreign sales due to domestic patent infringement under 35 U.S.C. §271(f)(2).
The US Court of Appeals for the Federal Circuit (the Court), sitting en banc, ruled on Monday, January 8, 2018, that a determination by the Patent Trial and Appeal Board (PTAB) as to whether a petition for inter partes review (IPR) is time-barred under 35 USC Section 315(b) is subject to judicial review.

Global law firm Dentons has appointed Milan-based partner Giovanni Casucci as Co-Head of the Europe Patent Litigation practice
Dentons secured a resounding victory for client Nistica, Inc. in one of the largest patent cases litigated in recent years in the U.S district courts, Finisar Corp. v. Nistica, Inc., Case No. 5:13-cv-03445. On April 5, the Federal Circuit Court of Appeals in Washington, DC ruled unanimously affirming Nistica’s complete victory in two jury trials in this large 6-patent case. The Federal Circuit’s order came within 24-hours of the oral argument.
