This article will summarize the most important changes to the Trade-marks Act, and discuss the challenges and opportunities of which companies should be aware. It will also discuss the early impact of the Combating Counterfeit Products Act (CCPA), and additional border and enforcement remedies available to trademark owners.
The Canadian government recently introduced a Bill which contained the most significant changes to Canada's trademark laws in modern history. Due to the fact that the revisions were contained in an omnibus Budget Implementation Bill (Bill C-31, Economic Action Plan 2014 Act, No. 1), they were introduced without consultation and passed despite serious concerns from intellectual property lawyers and businesses over their potential impact.
On April 6, 2017, the words "information location tool”, as they appear in s. 41.27 of the Copyright Act, R.S.C. 1985, c. C-42 (the Act), were given their first judicial interpretation. S. 41.27(1) provides that a copyright owner is not entitled to a remedy other than an injunction against a provider of an “information location tool” that is found to have infringed copyright by making a reproduction of a work.
