We represent our clients in complex building sector disputes involving claims concerning awarding construction assignments in tenders, additional remuneration, contractual penalties and improper performance claims, disputes over drawing performance bank guarantees and in FIDIC-based disputes.We also develop contracts for all types of construction and procurement methods. We provide advice and representation on risk assessment, dispute avoidance, claims management and dispute resolution. We litigate unresolved claims before the courts and arbitration tribunals, including before international arbitration boards.

Our clients include public and private owners, developers, builders, professional engineers and architects, general and specialized contractors, subcontractors, industrial equipment manufacturers, material suppliers, financial institutions, guarantors and other players in this field.

Experience

Covec: Representing in numerous disputes with the State Treasury, subcontractors and other entities–in a case related to construction of a stretch of the A2 Berlin-Warsaw motorway. Having terminated a motorway construction contract with the State Treasury, Covec is engaged in multi-party litigation including several separate cases with the State Treasury and subcontractors. Transaction value: €200 million.
International fashion "prêt-à-porter" company: Advising on public law litigation proceedings (administrative fines based on lack of big surface business license, lack of the necessary construction license, or based on commercial issues—sales at loss sanction proceedings—imposed by the Spanish local authorities) and on civil proceedings related to breaches of contracts caused by unauthorized works in the company’s establishments, trading as a renowned brand in Spain, and termination of urban leasing agreements.
Train operating company: Advising on a major dispute over late delivery of rolling stock. The case was brought before the Technology and Construction Court in England and raised a wide range of technical, financial and contractual issues, such as signalling, gauging, design variations, safety case acceptance, staffing and maintenance costs.
